Now what do I do about form 1310

I’m my late uncle’s niece and I filed his last tax returns through your software. He faithfully used your software. He has a refund and I’m not an official representative. The refund is now delayed. Is it true that the form 1310 was to be printed and sent in separately? How does someone know to do that if it’s not instructed to do so when filling out the return online through your software? Now that it’s delayed, can I still send that form in? What do I do now?

    According to the Form 1310 instructions, it can be filed electronically when it is attached to a Form 1040 or 1040-SR (see Where to File on the bottom of pg 1, https://www.irs.gov/pub/irs-pdf/f1310.pdf).

    The software is set up to make the process as easy as possible when filing a final tax return for someone who has died. When filling out the tax return information for your late uncle, you should have been asked if there was a court-appointed representative for your uncle. If you answered no, then you would have been prompted to provide the information needed to fill out Form 1310. Are you sure that the form wasn't included with the tax return you submitted for your uncle?

    If Form 1310 wasn't included with your uncle's 2025 tax return, you can file Form 1310 separately by mail. Send it to the Internal Revenue Service Center designated for the address shown on your completed Form 1310 above.
