Form 8958

I got married in August 2025. I live in TX and spouse lives in MN. We did not live together or transfer earned income in 2025. Do I need to complete form 8958? If I do complete it, does my spouse need to? We are filing married filing separately.

    Hi CherylMurray,

    There is another way you can file your taxes this year. This way you can e-file both returns and only use one account.

    1. File a Married Filing Joint(MFJ) federal return. This option will give you the best federal deductions.
    2. File a MFJ MN return, but file it as a nonresident. Then allocate what was earned in MN. The MN instruction book give this as an option when your spouse is not a resident of MN and income was not earned in MN by the nonresident spouse. See the instructions for Line 8 Residency on page 10 of the 2025 MN instructions.

    Otherwise, you need to complete a Form 8958 for and mail both your returns and include a copy of the Form 8958.
