I just moved to NC at the end of May 2025 but my wife and kids still live in sc.

can I still file tax as mfj in order to keep the subsidiaries for health coverage from market place when we live different states? I already have the nc driver's license and about to register a vehicle in NC as well.

Hello, Icy
That is a good question to ask. First of all, your Filing Status for your Federal return is not based on what state you reside in the U.S., and Married Filing Jointly is the best filing status when you are married.
As far your marketplace issue is concerned, your move from SC to NC is a major life change and you may want to revisit your insurance and communicate with Healthcare.gov to find out what steps you need to take at this time.
As far as how you file when 2026 comes around, contact Customer Support when you are read to file.

I did contact the healthcare and spoke with a couple of them but they are not inclined to give advice for tax filing.
I know I need to file married filing jointly and wanted to make sure I don't trigger anything when tax season comes around.
I am not gonna claim any of my kids and let my wife claim them.

Hi Icy,
I would recommend that you don't file as Married Filing Separately (MFS), which is what you would need to do to let your wife claim your children. You lose all sorts of credits, like the Earned Income Credit when filing MFS. You may want to contact support directly through your FreeTaxUSA account. If you have Pro Support, they can offer you some tax advice too. You still have 6 months to make a decision.
Filing the two state returns next year will be a little more complex, but Customer Support can help you with that. Married Filing Joint on your federal return is the best option and you will avoid all the complexities with Married Filing Separately.
