Hello,

My husband, who has sole custody of his daughter lives in Missouri and I live in Oregon (for the time being and there’s more to the story that will not be further discussed here). My husband does not earn income, he receives his veterans GI disability benefits - I have two questions; one, can we file jointly? Two, can I claim our daughter on our joint taxes?

    Hi CashewCheeseDip,

    When you are married, you have two options to file a tax return. Married Filing Jointly, or Married Filing Separate.

    Since his GI Disability Benefit is nontaxable, you may want to file jointly. His income would not be taxable in MO or OR. He would not need to file a MO tax return so, neither would you. That way you would have the benefit of also claiming his daughter on a joint return and you could claim the Child Tax Credit.
