Separated awaiting Divorce

Husband has been depositing his Social Security check into our joint bank account to maintain the home and pay his bills. As my lawyer puts it.. to maintain the status quo. This money will be taken by him after Divorce. I am trying to keep the home on my own. My question is … if I file Married filing Separately this year is his Social Security entered into my Income? I read Alimony is not included after 2018? If I'm not mistaken.

    Hello,

    Generally, no (unless you live in a community property state, then there is a good chance you may need to report it. Community Property states handles things differently). When you file a separate return, you should only report the income you personally received from a job, or a retirement plan, interest income, etc.

    If the social security was issued only to him and his SSA-1099 is in his name only, then you wouldn't report it on your own tax return.
