How to file amended returns for repayment to SSA for amounts under and over $3000?

What I found currently is for over 3000.

'Deductions / Credits' tab > drop-down menu > itemized deductions > other itemized deductions > drop-down menu > claim repayments >

I didn't found where to add a deduction for under 3000.

Please advise.

    Hi GM66,

    What you shared is the option for a deduction under 3,000. It must be itemized and is part of your itemized deduction. Enter it there.

    Generally when it is over $3,000 you do a Right of Claim Credit, which is much more involved.

    Thank you for the reply. I tried to file an amended return for 2022, for amount over 3000. But entering it under a claim of right didn't change the result. Other words zero federal return. There is something wrong.

    When did you pay back the SS Benefits? A Claim of Right is filed in the year you paid the amount back and is claimed as a refundable credit on your return. If you are having issues, contact Support so they can look at the details in your account.

    The claim of right repayment credit can be claimed if you meet the following requirements:

    • You repaid more than $3,000 in 2024
    • You aren't claiming a deduction for the repayment

    In most cases, you can claim the credit only if the repayment qualifies as an expense or loss incurred in your trade or business or in a for-profit transaction.

    For 2022, I received benefits from SSA and I paid income taxes. This year 2025 I received notification for overpayment. I repaid, but I paid taxes on this amount already and I want them back. I would like to use it as a deduction from the taxes I paid in 2022. My case: I am unemployed and if have zero income for 2025 (or nontaxable) the tax credit in 2026 will not work.

    Hello GM66,

    Since you paid back the amount in 2025, you will claim either a deduction, Itemized Deductions, or a credit on your 2025 tax return. The repayment does not qualify for either on your 2024 tax return or a prior year, like 2022.

    Hi Matthew,

    Thank you for the additional information. When I called IRS they transferred me to 4 different departments. The final one was Tax Law. The agent did tax audit by phone for my case and said I can file a return.

    I mailed it and added supporting documents. I will share the result when available.
