Is FreeTaxUSA available for my case?

Hello FreeTaxUSA Community,

I am wondering if FreeTaxUSA is available for me to file my taxes for 2023.

I am not a US citizen. I have South Korea citizenship and I came to the US in 28/Aug/2023 as Researcher with H-1B visa (work visa). Thus, I am nonresident alien.

These are my questions:
1 - Considering my case, would FreeTaxUSA be appropriate to file my taxes for 2023?

2 - If FreeTaxUSA is available, would I need to use the Pro Support considering my situation?

    Hi Gausss,

Thanks for contacting our community forum with your question. The IRS has some resources to help you make this choice.

First the IRS says this about H-1B aliens, "Generally, an alien in H-1B status (hereafter referred to as “H-1B alien”) will be treated as a U.S. resident for federal income tax purposes if he or she meets the Substantial Presence Test.

Basically, the substantial presence test states that you must be in the USA 183 days out of the last 3 years. If you did not meet that test at the end of 2023, then it would be best if you filed a 1040-NR: Nonresident US tax return for 2023 and if you meet those requirements in 2024, you could file using our service when you file 2024 in 2025.
